TOGETHER – Travel Smart VIP Invitees Program

Terms & Conditions

I. The Program               

1 This Program is managed and operated by Travel Smart Vacations Club, INC (TSVC) / Travel Smart VIP (“The Club”) in order to obtain names and contact information of potential customers to acquire the Travel Smart VIP Membership, to be able to contact and invite them to know their products and services without conditioning them to any purchase.

2 Travel Smart VIP Members (Referrers) are all those who belong to the Club through a Travel Smart VIP Membership.

3 TOGETHER – Travel Smart VIP´s Invitees Program (the “Program”) allows Referrers to obtain benefits through Referrals (“Invitees”) to enjoy preferential rate stays at Royalton Punta Cana, Memories Splash Punta Cana, CHIC Punta Cana by Royalton, Royalton White Sands, Royalton Negril, Royalton Saint Lucia, Royalton Antigua, Royalton Riviera Cancun and Royalton Suites Cancun (“Club Resorts”) and know the products and services of the Club. As it is a promotion, Referrals will only be able to enjoy preferential rates for one time.

4 Members who enroll Referrals to the Program will not be able to process the sale or negotiation of the Travel Smart VIP Membership or related products.

5 Members may refer a maximum of 5 contacts per year and may make modifications to the shared contacts, as well as unsubscribe them by sending an email to the address together@travelsmartvip.com.

II. Elegibility

1 Members eligible to participate in the Program will be those who personally receive a written invitation after the purchase of a Membership. Registration to this Program will not be conditioned to the level of Membership purchased and to a discrimination character of any kind.

2 Members who do not receive the written invitation to enroll in the Program may request it with an authorized representative located at the Travel Smart VIP offices of the resort that are visiting or phone call to 1-888-999-4759 (USA & Canada) or write an email to together@travelsmartvip.com.

3 Registration for the Program is completely free.

4 The Member must complete the registration form and provide at least the mandatory contact details (name, address, telephone and e-mail) of 5 Referrals that may be interested in joining the Club.

III. Invitees accommodation reservations

1 – The Referrals will be contacted to be invited to travel to any of the Club Resorts of their choice by paying a preferential rate that covers the cost of lodging as well as food and beverages in a mandatory manner (All Inclusive modality).

2 – The current list of participating resorts may be consulted at www.travelsmartvipblog.com/together and is subject to availability and changes without prior notice. All participating resorts operate under the All Inclusive modality.

3 – All Invitees who decide to travel must pay the total price for their stay prior to arrival at the resort and are subject to attend the presentation of Travel Smart VIP´s vacation concept with a duration of approximately 90 minutes the next day of their check-in. In case the Invitees decide not to attend the presentation during their stay, the automatic charge of the current public rate managed in the front desk of the resort will be applied and must be mandatory paid.

4 –  The preferential price of the stay is determined by: the number of people traveling being 4 the maximum allowed by reservation, duration of stay being 5 nights the maximum allowed by reservation, travel season excluding the Special holiday season (1st to 8th of January, 15th to 23rd of April and 16th to 31st of December), type of resort and type of room being the Studio Standard category the only available for this Program.

5 – All reservations done by Invitees must be made at least 30 days prior to the estimated date of arrival at the resort.

6 – All reservations are subject to availability.

7 – For security reasons when booking, all Invitees must confirm the name of the Referrer. Only one Referrer per guest can be confirmed.

8 – Cancellation policies for travel reservations made by Invitees are:

Cancellation requested 91 days prior to the date of arrival at the resort, 100% of the amount paid may be taken as a balance in favor for future reservations within a period of 12 months.

Cancellation between 90 and 30 days prior to the date of arrival at the resort, a fee of 100 USD will be charged as a penalty and the rest of the amount paid may be taken as a balance in favor for future reservations within a period of 12 months.

Cancellation between 29 or less days prior to the date of arrival at the resort, the amount paid will not be refunded or taken as a balance in favor for future reservations.

–  There are no refunds of any kind in case of cancellation.

9 – Preferential rates for Invitees may not be used in conjunction with another offer or promotion and the rate offered may not be transferred to other persons outside the Program.

10 – The subscribed Referrals may only travel once through the Program’s promotional rates. In case of doing so on subsequent occasions, the total rack rate will be charged.

 

IV. Gifts for the Travel Smart VIP Member

1 – The Program grants Rewards to Referers in appreciation of their participation. These Rewards are conditioned on the following criteria:

 

 

 

 

 

 

 

 

 

2 – In order to receive the benefits and promotions offered in “Together” the referral must have been enrolled by the referrer Member prior to the check in date of the referral.

3 – All Rewards will be granted only to any of the Membership holders and may not be transferable to another person.

4 – In case there is a duplication in the registration of Referrals, the Referrer confirmed by the Invitee at the moment of making the reservation will be the one who is awarded any corresponding Rewards.

5 – All Referrals enrolled in the Program will be contacted and invited to travel through the exclusive promotions for a period of 12 months. In the case that the Referrals are not contacted for any reason and the time of 12 months has elapsed, Referrals will not generate any Reward for the Referrer.

6 – The Club reserves the right to contact the Referrals for an indefinite time.

7 – If a person whose contact information belongs to the Program, travels under a status other than that of the Invitee, no Rewards will be generated for the Referrer.

8 – The Rewards offered in the Program may change without prior notice and are subjected under the criteria of the Club.

V. Invitees qualification criteria

As it is an exclusive promotion, all the Invitees who are referred by the Referrer must comply with the requirements set out below:

A. SELECT Invitee

1 – In order for the Referrer to receive a Reward for an Invitee with the SELECT profile, the Invitee must comply with the following requirements when attending to the Travel Smart VIP´s presentation:

2 – Have between 30 – 70 years of age.

3 – Going as a couple (spouse or partner in free union) to the presentation of Travel Smart VIP´s vacation concept that lasts approximately 90 minutes, the day after arrival at the resort.

4 – Present at the time of registration to the Club´s presentation, at least 2 valid international credit cards issued by VISA, MasterCard, American Express or Discover.

5 – Must present valid official identifications that validate the place of residence and show the same residential address.

6 – All Invitees working within a branch directly related to the international tourism industry (travel agencies, hotels, cruise lines, airlines and the like) will not get this qualification.

7 – All Invitees traveling with a Travel Smart VIP’s employees membership will not get this qualification.

 

B. Regular Invitee

Within this classification are all people who do not meet one or more of the SELECT Invitee requirements, however they must present the following requirements when attending to the Travel Smart VIP´s presentation:

1 – Have between 30 – 70 years of age.

2 – Attend as a couple the presentation of Travel Smart VIP´s vacation concept that lasts approximately 90 minutes, the day after arrival at the resort.

3 – Present at the time of registration to the Club´s presentation, at least 2 valid international credit cards issued by VISA, MasterCard, American Express or Discover.

4 – Must present valid official identifications that validate the place of residence and show the same residential address.

        5 – Regular Invitees will only generate a Reward to the Referrer if they purchase a regular Travel Smart VIP membership. 

VI. Redemption and use of Rewards

 

1 –  The Rewards offered within the Invitee Program are based on a prepaid gift card that credits the person whose name appears on the card thereof (“Cardholder”) with the US dollar equivalent of the marked value.
2 – This TravelSmart VIP Cash Card (“card”) will be issued by All Trans Financial Services Credit Union Limited (“Operator”) pursuant to license by Visa International, which allows to use its equivalent cash value for purchases in establishments that operate with this modality of payment. Use of this card is governed by this Agreement.
3 – Any Member that receives a card agrees to the card issuer agreements, understanding that the cardholder’s relation will be with the card issuer and TravelSmart VIP will cover the liaison duties.
4 – Issued cards are Operator property. The Cardholder acknowledges and understands that the cards are owned by the Operator and it may cancel any or all cards at any time for any reason with or without reasonable prior notice to TravelSmart VIP or Cardholders.
5 – The Operator will be responsible for providing support and service exclusively for the physical use of the card; as well as maintenance support for the VISA payment platform.
6 – For each established action of the Program that merits a Reward, a card will be issued with the corresponding amount and will be sent to the address of the Referrer previously registered at the time of registration.
7 – Cards emitted will take approximately 30 working days to be delivered via mail at the address of the Referrer.
8 – Cards must be activated prior to use in the telephone that is indicated on the sticker attached to the front.
9 – The validity of cards is 12 months from the date of issue marked at the front.
10 – Due to their nature, cards cannot be exchanged for cash and its resale is strictly prohibited.
11 – The Cardholder of the card will be solely responsible for the use given to it.
12 – The use of cards is limited to payments in establishments operating with VISA payment platform. They do not apply for cash withdrawals at ATMs or for merchandise purchases over the Internet.
13 – The Club is not responsible for the damage or loss of cards after the delivery date at the address of the Referrer.
14 – Card Fraud. TravelSmart VIP shall not be responsible for any loss caused by or resulting from any Cardholders’ fraud, misuse, or negative balance transactions involving the Cards except to the extent such loss was caused by TravelSmart VIP’s breach of a representation, warranty, or covenant of this Agreement or if TravelSmart VIP (or any of its employees, agents or representatives) participated in or had knowledge of any deceptive, fraudulent or other illegal activity. Cardholder agrees to comply with all reasonable requests made by TravelSmart VIP to investigate, prevent and recover sums due relating to any actual or suspected loss, fraud, or other improper use of any Card.
15 – Indemnity. The Cardholder agrees to indemnify, defend, and hold harmless TravelSmart VIP together with its agents, employees, directors, officers, shareholders and affiliates, for any claims, losses, or damages, including reasonable attorneys’ fees, resulting from the Cardholder’s negligent acts or the breach of any term or provision of this Agreement.

 

The Travel Smart VIP´s TOGETHER Invitee Program is subject to change, cancellation or limitation at the discretion of Travel Smart Vacations Club, Inc. (TSVC) and affiliated companies.
